Director of Intellectual Property, Civil Enforcement – October 2012-Present
Represent Louis Vuitton, Christian Dior, Marc Jacobs, Céline, Givenchy, Emilio Pucci, Kenzo, Berluti, and Loewe with respect to intellectual property matters in North America. Manage all aspects of North American civil intellectual property enforcement program, including, coordinating investigations; drafting cease and desist letters; managing outside counsel; reviewing complaints, discovery documents, and motion papers; and handling settlement negotiations. Counsel brands with respect to various issues including, trademark clearance and prosecution issues; enforcement strategies; trade dress; defensive matters; and transactional agreements, including, licenses, assignments, and releases. Manage staff of three full-time and up to four seasonal employees. Set budgets and priorities for North American civil enforcement program with direct report to Louis Vuitton’s Global Intellectual Property Director in Paris.

Handled all aspects of intellectual property litigation and represented clients before the U.S. Trademark Office and U.S. Copyright Office on trademark and copyright prosecution proceedings. Significant matters included obtaining jury verdict for defendant record label in a copyright infringement action arising out of the alleged unauthorized use of sound recordings in a video game and successfully opposing trademark application for mark that created a similar commercial impression to client’s world-famous alcoholic beverage mark.

Provided prepublication review, counseling, and editorial staff training for publisher of Maxim, Stuff, Blender and The Week magazines, and documentary film producers. Successfully represented magazine publisher on an application for a Temporary Restraining Order and Order of Recall in a trademark and copyright infringement suit against an adult video company claiming to “parody” publisher’s magazines. Drafted and negotiated various intellectual property agreements, including licenses, assignments and talent agreements.

Handled all aspects of civil litigation involving intellectual property law, with focus on anti-counterfeiting and anti-piracy matters. Significant matters included representing world famous apparel and sporting goods brands in several anti-counterfeiting actions resulting in multi-million dollar settlements and representing a major sportswear company in a trademark infringement action that resulted in a bench verdict of nearly $7 million.
